Liability and Intellectual Property Waiver

I ACKNOWLEDGE AND AGREE that in participating in any class, workshop, event or other activity hosted by Canadian Pole and Aerial Sports Inc. ("3Sixty Dance & Fitness", “3Sixty”), whether in studio, off site, or in my own home, I am assuming any and all risks of personal injury, death or loss resulting from same.

Waiver of Liability

• I hereby waive, release, and discharge all claims that I have or may have in the future, and covenant not to sue 3Sixty, its administrators, directors, agents, officers, volunteers, employees, contractors, other participants, any sponsors, advertisers, owners, and lessors of the premises on which the activity takes place (each considered one of the "releasees" herein) from all liability, claims, demands, losses, damages, on my account caused or alleged to be caused in whole or in part by the negligence of the releasees or otherwise, including negligent rescue operations.
• I further agree that if, despite this release, waiver of liability, and assumption of risk, I or anyone on my behalf makes a claim against any of the releasees, I will indemnify, defend, and hold harmless each of the releasees from any loss, liability, damage, or cost, including attorneys' fees, which any of the aforementioned may incur as a result of such a claim.

Statement of Good Health

• I confirm that I am in good health and am capable of participating in the activities for which I am enrolling. If I have any concerns or uncertainty regarding my ability to participate, I will seek the advice of medical professionals before participating.

Proprietary Information and Media

• I also acknowledge and agree that by participating in any dance or fitness class, I will learn content, including but not limited to dances, routines, course content and curriculum, that has been created by 3Sixty (“3Sixty Proprietary Information”). 3Sixty Proprietary Information is proprietary to 3Sixty and cannot be disseminated without 3Sixty‘s prior written consent.
• 3Sixty often shoots photos and videos of individual or class activities for reference, promotional or other purposes. I acknowledge and agree that by participating in activities at 3Sixty, I may appear in such media, and such media may be used by 3Sixty for promotional purposes. Further, signing a media release waiver may be mandatory for participation in large performances, such as 3Sixty “Showcases”. 3Sixty retains exclusive rights to all media produced by 3Sixty, unless specifically stated. I may contact 3Sixty to discuss options, if I don't want to be included in promotional material.

Participation in Online Program

• I understand that training at home carries additional risk and will not hold 3Sixty responsible for injuries or damage that occurs as a result of my actions. I understand that an instructor will not be present at my location and I will be responsible for my own safety.
• I acknowledge and agree that by participating in online studio activities at 3Sixty, I may choose to broadcast audio/video of myself over the internet and may be visible to other students. 3Sixty Dance & Fitness Inc. uses third party software for our online communications and we do not guarantee the privacy of your video, should you choose to broadcast yourself.
• I will not use screen-capture software or otherwise attempt to download, copy or save 3Sixty Proprietary Information provided online.
  

Statement on COVID-19

• I represent that I am in good health and have had no known exposure to COVID-19 and no symptoms of COVID-19, including fever/chills, cough, difficulty breathing, sore throat, runny nose, loss of taste/smell, nausea, vomiting, diarrhea, or other unexplained ailments, for 14 days prior to attending the facility.
• I acknowledge that if I believe I have had any exposure to COVID-19, I will immediately cease attendance at the facility until I can again warrant that I have had no known exposure for the 14 day period and alert the facility if I have been on the premises since my exposure.
• The facility is making its best efforts to reduce the risk of transmission of COVID-19, but the safety of the community is in the hands of every one of us. I expressly agree and promise to abide by all safety precautions as posted in the studio and instructed by 3Sixty staff. I understand these requirements may evolve over time as the situation changes.
• I am aware that training during and after the COVID-19 pandemic involves certain inherent risks, dangers and hazards, which can result in serious infection, personal injury or death. I further acknowledge, understand, appreciate, and agree that my participation may result in possible exposure to and illness from COVID-19. While protocols and personal discipline may reduce this risk, the risk of serious injury, illness, and even death is not possible to fully mitigate.
• I hereby freely agree, to assume and accept all known and unknown risks of exposure to COVID-19, even arising from the negligence of the releasees or others and assume full responsibility for my participation. I further recognize and acknowledge that the risks inherent in training can be greatly reduced by careful adherence to all public health recommendations.

3Sixty reserves the right to modify the terms of this waiver from time to time. I acknowledge that I have read and will abide by the latest Studio Policies, which can always be found on the 3Sixty website. (www.3sixtydanceandfitness.com/policies/)

Declaration

I hereby confirm that I have read this Liability and Intellectual Property Waiver, understand it and the implications of signing it, and declare that I am at least eighteen years of age and of sound mind and that I am signing this Liability and Intellectual Property Waiver voluntarily and of my own free will

Purchase Policy

All sales are final, unless specifically noted below.

Temporary Holds

1. Holds will not be provided on recurring monthly memberships, which may be cancelled at any time by the client.

For all other purchases, including but not limited to workshops, youth programs, gift certificates, and merchandise, all sales are final.

Terms and Conditions

I agree to abide by 3Sixty's posted Studio Policies, which can be found on 3Sixty's website (www.3sixtydanceandfitness.com/policies).

Privacy Policy

3Sixty must collect personal information in order to offer the services provided and will take all reasonable measures to ensure the safety and security of such data.

3Sixty will never give out, sell, or otherwise make available the personal information of any client, except as required in the cooperation with legal proceedings.

3Sixty uses third party services, such as Thinkific, to facilitate our business services. By using these services, you are agreeing to the terms and conditions and privacy policies of these third party sites as well.
